These Terms of Service (“Terms”) govern your use of the website and services provided by Mold Check and Inspect (“we,” “us,” or “our”). By accessing our website or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.
Our Services
Mold Check and Inspect provides mold assessment and testing services, including air and surface sampling, infrared moisture detection, and related reporting. We are licensed mold assessors. We do not perform mold remediation or removal. Our role is to test, assess, and report, not to remove or remediate mold.
Nature and Limitations of Inspections
You understand and agree that:
- A mold assessment is a limited, point-in-time evaluation of the conditions present at the time of the inspection. Mold and moisture conditions can change, and results reflect only what was observed and sampled on the date of service.
- Our assessment is limited to areas and materials that are safely and readily accessible. We do not perform destructive testing unless separately agreed in writing.
- We do not guarantee that a property is, or will remain, free of mold, moisture, or related conditions. Absence of detected mold at the time of testing is not a guarantee that mold is not present elsewhere or will not develop later.
- Laboratory analysis is performed by an independent, accredited third-party laboratory. We report those results but are not responsible for the laboratory’s methods or findings.
Client Responsibilities
You agree to provide accurate information about the property, to provide safe access to the areas to be inspected, and to disclose any known history of water damage, leaks, or prior mold issues. Inaccurate or incomplete information may affect the accuracy of our assessment.
Reports
Inspection reports are prepared for the client who ordered the service and are based on conditions observed at the time of inspection. Reports may not be relied upon by third parties without our written consent. Any remediation protocol we provide is a recommendation; the choice of remediation contractor and the performance of remediation work is solely the client’s responsibility.
Scheduling, Payment, and Cancellations
Fees for services are due as agreed at the time of scheduling or service. If you need to cancel or reschedule, please contact us as early as possible. We reserve the right to charge for missed appointments where access could not be provided.
Disclaimer of Warranties
Our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. We do not warrant that our services will detect all mold or moisture conditions.
Limitation of Liability
To the fullest extent permitted by law, the total liability of Mold Check and Inspect arising out of or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to property damage, health effects, loss of use, or diminished property value.
Indemnification
You agree to indemnify and hold harmless Mold Check and Inspect and its owners, employees, and agents from any claims, damages, or expenses arising out of your misuse of our reports or services, or your provision of inaccurate information.

Governing Law
